These Terms of Service (“Terms”) govern your access to and use of the Vopon VPN applications, website, and related services (collectively, the “Service”) provided by A.C BELNET DIGITAL LTD (“Vopon VPN,” “Vopon,” “we,” “our,” or “us”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 18 years old to use the Service.

1. About the Service

Vopon VPN provides a subscription-based virtual private network service intended to help users establish an encrypted connection through supported servers and networks.
The Service is provided for lawful personal or internal business use, subject to these Terms.
Your use of the Service is also governed by our Privacy Policy, available at:

2. Eligibility

To use the Service, you must:

• be at least 18 years old;
• have the legal capacity to enter into a binding agreement;
• comply with these Terms and all applicable laws and regulations.

If you do not meet these requirements, you may not use the Service.

3. Accounts and Access

To use the VPN service, registration is required.
You may access the Service using one or more supported login methods, including:

• Sign in with Apple;
• Sign in with Google;
• email with one-time password (OTP).

You are responsible for maintaining the security of your account and for all activity that occurs through your account.
You may not share your account with other people or allow unauthorized persons to use your account credentials to access the Service.
We may suspend or restrict access if we reasonably believe your account is being misused, compromised, or used in violation of these Terms.

4. Subscriptions, Plans, and Free Trial

Vopon VPN is offered on a subscription basis.
Subscription plans may include:

• monthly plans;
• yearly plans;
• two-year plans.

Vopon VPN may also offer a 3-day free trial or other promotional trial periods.
If a free trial is offered, and you do not cancel before the end of the trial period, your subscription may automatically convert into a paid subscription according to the terms presented at the time of purchase.
Current subscriptions are processed through:

• Apple In-App Purchase;
• Google Play Billing.

Subscriptions purchased through Apple or Google may automatically renew unless cancelled in accordance with the applicable platform rules.
You are responsible for managing and cancelling your subscription through the platform through which you purchased it.
Deleting the application does not automatically cancel your subscription. If you uninstall the app without cancelling your subscription, the subscription may continue to renew and you may continue to be charged according to the applicable platform terms.

5. Payments, Renewals, and Refunds

All fees are payable in advance unless otherwise stated.
Pricing, billing intervals, and included features may vary by plan, country, platform, or promotional offer.
Refunds, where available, are handled according to the rules of the platform through which the purchase was made, unless applicable law requires otherwise.
For subscriptions purchased through Apple App Store or Google Play, cancellation and refund requests are generally governed by the relevant platform’s billing and refund rules.
Vopon VPN does not promise prorated refunds unless required by applicable law or the rules of the relevant payment platform.
If additional payment methods are introduced in the future, including services such as Telegram Stars, cryptocurrency, or other payment channels, those payments may be subject to separate billing, cancellation, and refund rules disclosed at the time of purchase.

6. Acceptable Use

You agree to use the Service only in a lawful and responsible manner.
You may not use the Service for activities that:

• violate any applicable law or regulation;
• infringe the rights of others;
• interfere with, disrupt, damage, disable, overburden, or impair the Service, our infrastructure, or the experience of other users;
• create excessive operational load, bandwidth consumption, or automated traffic that is unreasonable for normal intended use;
• increase the risk that servers, IP addresses, domains, or related infrastructure become blocked, blacklisted, rate-limited, or degraded;
• attempt to bypass account, session, device, traffic, or usage restrictions;
• distribute malware, viruses, harmful code, spam, or abusive automated requests;
• facilitate bot traffic, abusive scraping, mass automation, denial-of-service activity, or similar misuse;
• involve torrenting, peer-to-peer abuse, or other traffic patterns that may materially harm the Service or infrastructure;
• support fraud, harassment, stalking, threats, identity misuse, unauthorized access, or other harmful conduct.

You may not use the Service in a way that materially threatens the stability, availability, integrity, or reputation of the Service or its supporting infrastructure.

7. Enforcement, Suspension, and Termination

We may investigate suspected violations of these Terms.
We may, at our reasonable discretion, suspend, restrict, or terminate access to the Service if:

• you violate these Terms;
• your use creates excessive load or risk for the Service;
• your use threatens the stability, security, availability, or reputation of the Service or infrastructure;
• your account is involved in conduct that may expose the Service to blocking, blacklisting, abuse complaints, or operational harm;
• we are required to do so for legal, regulatory, technical, or security reasons.

In serious cases, we may remove access without prior notice.
We may also block or limit future access where reasonably necessary to protect the Service.
Termination or suspension of access does not automatically entitle you to a refund, except where required by applicable law or the rules of the relevant payment platform.

8. Device and Session Limits

The Service may apply limits to the number of devices or simultaneous sessions that may be used under one account.
At present, Vopon VPN may allow up to 5 devices per account.
We reserve the right to change device or session limits at any time, including for technical, security, commercial, or operational reasons.

9. Service Availability and Performance

The Service is provided on an “as available” basis.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or continuously available in every location, on every network, or on every device.
Speed, availability, latency, and server performance may vary depending on many factors, including:

• region;
• local network conditions;
• ISP restrictions;
• device limitations;
• third-party service conditions;
• routing conditions;
• infrastructure issues beyond our control.

Some countries, networks, internet providers, or service providers may restrict, degrade, or block VPN traffic or access to the Service.
We do not guarantee:

• access to every server location at all times;
• compatibility with every network or device;
• access to or unblocking of all websites, apps, platforms, or streaming services;
• uninterrupted service.

10. Changes to the Service

We may, at any time and without liability to you:

• add, remove, or modify features;
• add, remove, replace, or relocate servers;
• modify subscription plans or pricing;
• change technical requirements;
• discontinue part of the Service;
• change device, session, or usage limits;
• update or modify the Service for legal, operational, technical, or commercial reasons.

Where required by applicable law or platform rules, we will provide notice of material changes in an appropriate manner.

By using the Service, you acknowledge that we may collect and process information as described in the Privacy Policy.

12. Third-Party Platforms and Services

The Service may rely on third-party platforms and providers, including authentication providers, payment processors, infrastructure providers, app distribution platforms, and email services.
Your use of such third-party services may also be subject to their own terms, policies, and rules.
We are not responsible for third-party products or services that we do not control.

13. Export Controls and Compliance

You may not use the Service in violation of applicable export control, sanctions, trade restriction, or similar laws and regulations.
You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
Vopon VPN disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or uninterrupted use.
Without limiting the above, Vopon VPN does not warrant that:

• the Service will meet your requirements;
• the Service will always be available, fast, secure, or error-free;
• the Service will prevent all tracking, interception, monitoring, or blocking;
• the Service will allow access to every service, website, app, or region-restricted platform;
• the Service will be compatible with every network, carrier, or device.

15. Limitation of Liability

To the maximum extent permitted by law, Vopon VPN, A.C BELNET DIGITAL LTD, and their directors, officers, employees, affiliates, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or use, arising out of or related to your use of, inability to use, or reliance on the Service.
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if we were advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of:

• USD 100;
• the amount you paid to Vopon VPN for the Service during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded or limited under applicable law.

16. Responsibility for Use of the Service

You use the Service at your own risk.
Vopon VPN is not responsible for losses, damages, claims, liabilities, or consequences resulting from:

• your unlawful use of the Service;
• your misuse of the Service;
• your violation of these Terms;
• actions taken by third parties against you based on your conduct;
• network restrictions, blacklisting, regional blocking, or service limitations beyond our reasonable control.

17. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Vopon VPN, A.C BELNET DIGITAL LTD, and their directors, officers, employees, affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to:

• your use or misuse of the Service;
• your violation of these Terms;
• your violation of any applicable law or regulation;
• your infringement of any third-party rights;
• any unlawful or harmful activity conducted through your account.

18. Changes to These Terms

We may update these Terms from time to time.
If we make changes, we will update the “Last Updated” date above. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the Service.

19. Informal Dispute Resolution

Before starting formal legal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally.
You and Vopon VPN agree to make a good-faith effort to resolve any dispute, claim, or controversy through informal communication before initiating arbitration.

20. Arbitration and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding arbitration, except where applicable law does not permit mandatory arbitration.
The seat or legal place of arbitration shall be Israel, and the arbitration shall be conducted in English unless otherwise required by law.
Each party shall bear its own costs, unless the arbitrator determines otherwise in accordance with applicable law or arbitration rules.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where necessary to protect rights, property, security, or confidential information.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented at the time of purchase or use, constitute the entire agreement between you and Vopon VPN regarding the Service and supersede prior or contemporaneous understandings relating to the Service.
